Who is liable for a subcontractor's prevailing wage violation?
Liability can reach the prime contractor and, in some circumstances, the awarding body. This is precisely why agencies monitor rather than relying on contractor certification alone. Monitoring is far cheaper than back wage exposure.
Does prevailing wage apply to a private project with public funding?
It can. Public subsidy, tax increment financing, below market land conveyance, and certain public benefit arrangements can trigger coverage on otherwise private projects. The analysis is fact specific and worth performing before construction rather than after.
How often should certified payroll be reviewed?
Every payroll period, as it is submitted. Reviewing quarterly means a classification error can run for months and compound into a substantial restitution obligation. Contemporaneous review keeps errors small.
